1. ACCEPTANCE OF TERMS

By accessing and using Tendencia Vital (hereinafter "the Application" or "the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.

2. AGE AND ACCOUNT REQUIREMENTS

Vital Trend is a service for people over 18 years of age only. By creating an account, you declare that you are 18 or older and you are responsible for that declaration. If we become aware that an account belongs to a person under 18, we will close it and delete its data.

Your account is personal. You are responsible for keeping your password confidential and for any activity carried out with your account.

3. NATURE OF THE SERVICE

⚠️ NOTICE: Tendencia Vital is exclusively a support, education and general wellness tool. We are NOT medical professionals, certified nutritionists or licensed trainers.

The contents, recommendations and data provided by the Application are informational and educational in nature. Under no circumstances do they replace professional medical advice, diagnosis or treatment. Always consult your physician or another qualified healthcare professional before starting any exercise program, diet or lifestyle change.

This notice applies equally to all Artificial Intelligence Mentors in the ecosystem (Health, Pets, Finance, Spirituality) and to any "consultation" or interaction the user has with them — the term "consultation" describes the interaction with the AI, and does not constitute a professional medical, veterinary, financial or spiritual consultation.

4. PERMITTED USE AND PROHIBITED CONDUCT

You agree to use the Service responsibly. The following is prohibited:

Using the Service if you are under 18 years of age.
Sharing your account or credentials with other people.
Copying, automatically extracting, reselling, redistributing or publishing the Service's content.
Attempting to gain unauthorized access to other people's accounts, systems or data, or interfering with the operation of the Service.
Impersonating another person.
Uploading content that is illegal or infringes third-party rights (see section 6).

If you breach these Terms, we may suspend or close your account. Before doing so, we will notify you by email and give you a period to respond or correct the breach. In serious cases, such as unauthorized access to accounts or systems, impersonation or uploading illegal content, we may suspend the account immediately.

If we suspend or close your account for a breach, the plan already paid is not refunded and, if you had the Founder Price, you lose it. This does not limit the rights that the law grants you as a consumer.

5. CONTENT OWNERSHIP

The PDFs, artificial intelligence mentors, videos, texts, designs and trademarks of Vital Trend belong to Vital Trend or are used under license. Your plan gives you a personal, limited, non-exclusive, non-transferable license to use them within the Service. This license does not include copying, reselling, sharing or publishing that content.

The content you upload (for example, food photos) remains yours. You authorize us only to process it in order to provide the Service.

6. USER CONTENT AND THIRD-PARTY RIGHTS

The Application allows users to upload content (for example, food photographs through the AI Food Analyzer). By uploading content, you represent and warrant that:

You own the rights to that content, or have authorization to share it
The content does not infringe intellectual property, privacy, or any other third-party rights

Tendencia Vital will have a registered DMCA Agent to handle copyright claims related to content hosted on the platform, in accordance with Section 512 of the U.S. Digital Millennium Copyright Act (DMCA).

7. CONTENT CORRECTION AND TAKEDOWN

If you believe any content on the Application infringes your rights (copyright, image, or others), you may file a claim through legal@tendenciavitalapp.com.

The claim must include:

Identification of the claimant (full name and contact details)
Description of the work or right allegedly infringed
Exact location of the content within the platform (URL or section)
A good-faith statement that the use is not authorized by the rights holder, their representative, or the law

Tendencia Vital commits to responding to every claim within 10 business days of receipt, and to removing or correcting the disputed content without requiring prior legal proceedings, when the claim is duly substantiated.

8. LIMITATION OF LIABILITY

Tendencia Vital is provided "as is" and "as available". We do not guarantee specific health, wellness, financial or any other results, nor that the service will operate without interruptions or errors, nor that content generated by artificial intelligence is accurate or complete.

To the extent permitted by law, Tendencia Vital, its creators, affiliates or collaborators will not be liable for indirect, incidental, special or consequential damages arising from the use of, or inability to use, the service. If any liability exists, the maximum amount you may claim is the amount you paid for the service in the 12 months before the event giving rise to the claim.

You decide how to use the information provided by the service and you are responsible for the decisions you make with it. Nothing above limits liability that the law does not allow to be limited, or your rights as a consumer.

9. SUBSCRIPTIONS AND PAYMENTS

Subscription plans are billed according to the selected period (monthly or annual).

Renewal and charges: when you pay for the first time, you choose whether to accept that your plan renews and is charged automatically at the end of each period until you cancel, or to pay for a single period only, with no later charges. Before each automatic charge we will notify you in advance so you can continue or cancel. If your subscription is cancelled, is not renewed, or a payment is not completed, your account will move to the Free tier at no cost.

Before any trial period or paid plan expires, we will notify you so you can decide whether to continue.

Progress preservation: if your account moves to the Free tier due to non-renewal, your progress, history, and activity streak will be preserved. Upon reactivating your subscription, you can continue where you left off.

Founder Price: the first 100 users who subscribe to a paid plan during the launch period will receive a preferential price ("Founder Price"), guaranteed for 2 years from their first subscription, regardless of any changes to list prices during that period. This benefit is conditioned on maintaining an active, uninterrupted subscription. If the user stops paying at any point during those 2 years, they permanently lose the Founder Price; if they later decide to reactivate their subscription, they will do so at the list price in effect at that time, not the original price they subscribed at.

Refunds: you may request a refund of the first payment for a plan within 15 days of that payment, for any reason and without needing to explain. This refund is granted once per customer. To request it, write to soporte@tendenciavitalapp.com; the refund is made through the same payment method within 14 days at most. After the 15 days, partial unused periods are not refunded. If we charge a renewal without having notified you beforehand, we will refund it. If you request a refund and had the Founder Price, you lose it.

10. DISPUTE RESOLUTION

Any dispute arising from the use of the Service will first be attempted to be resolved directly and in good faith between the parties, by contacting legal@tendenciavitalapp.com, within 30 days of the dispute arising.

If no agreement is reached within that period, the dispute will be submitted to binding arbitration, instead of going directly to court, under the following conditions:

The arbitration will be conducted in accordance with the laws of the Republic of Peru, Tendencia Vital's jurisdiction of operation
The arbitration will be individual — the user waives the right to participate in class actions or group claims against Tendencia Vital, to the extent permitted by the applicable law in their jurisdiction
The language of the proceeding will be Spanish, unless otherwise agreed by the parties
This clause does not limit the user's right to resort to mandatory consumer-protection mechanisms in their country of residence, when local law so requires

11. MODIFICATIONS

We reserve the right to modify these terms at any time. Changes will take effect immediately upon publication in the Application. Continued use of the service constitutes acceptance of the modified terms.
